Terms of Service

These Terms of Service ("Terms") govern your use of the The Trading Path website at thetradingpath.net and its subdomains (including the trade journal), its tools, downloads, indicators, academy and our Discord bot (together, the "Service"). The Service is operated by The Trading Path ("we", "us", "our"). By signing in to or using the Service you agree to these Terms, our Privacy Policy and our Risk Disclaimer. If you do not agree, do not use the Service.

Everything provided through the Service — levels, charts, calculations, conversions, simulators, indicators, videos, AI-generated commentary, community posts and any other content — is general information for educational purposes only. We are not a registered investment adviser, broker-dealer, commodity trading advisor, or financial planner, and nothing in the Service is a recommendation or solicitation to buy, sell or hold any security, futures contract, option or other instrument, or advice tailored to your circumstances. 3. Data, calculations and accuracy

Market levels and statistics in the Service are estimates derived from third-party market data and our own calculations and models. They may be delayed, incomplete, inaccurate or unavailable, and conversions between indices, ETFs and futures are approximations. We do not guarantee the accuracy, completeness, timeliness or availability of any data or content. Always verify information independently before relying on it.

4. AI features

Some content (for example the morning bias and the chat assistant) is generated automatically by artificial intelligence. It can be wrong, incomplete or out of date and is not reviewed individually before you see it. Do not treat it as advice, and do not enter personal, financial or sensitive information into AI features. Questions you type are sent to a third-party AI model provider to produce an answer, as described in the Privacy Policy.

You keep ownership of content you add, such as trade-journal entries, notes, screenshots, questions, comments and replies ("Your Content"). You grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy and display Your Content only as needed to operate the Service. Questions, comments and replies you post in the academy are visible to other members together with your Discord display name. You are responsible for Your Content and confirm you have the right to post it. We may remove content that breaks these Terms.

7. Intellectual property

The Service and its content (software, design, text, graphics, videos, level files, indicators and other materials), other than Your Content and third-party materials, are owned by us or our licensors and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own trading education, subject to these Terms. Scripts that carry their own licence header are licensed under that licence. Third-party names and trademarks shown in the Service belong to their owners; see Licenses & notices. No affiliation with or endorsement by those owners is implied.

8. Third-party services, partners and affiliate links

The Service links to and integrates third-party services (for example Discord, YouTube, charting platforms, brokers and proprietary trading firms). We do not control and are not responsible for them, and your use of them is governed by their own terms. Some partner links are affiliate links: we may earn a commission if you buy through them, at no extra cost to you. Offers, discount codes, prices and rules shown for partners are set by the partners and may change at any time; always check the partner's own site before buying. Any purchase from a partner is solely between you and that partner.

The Service itself does not take payments. If you buy paid access (for example a paid community role) through a third-party checkout, that purchase is also governed by the checkout provider's terms and by our Refund Policy. We do not add hidden fees.

10. Availability and changes

We may change, suspend or discontinue any part of the Service at any time, including features, data sources and tools, and we do not guarantee that the Service will be uninterrupted, secure or error-free.

11. Suspension and termination

We may suspend or end your access at any time, including if you break these Terms, if your Discord role or membership changes, or to protect the Service or other members. You may stop using the Service at any time and can delete your data from the Your data page. Sections that by their nature should survive termination (including 2, 3, 5–7 and 12–16) will survive.

12. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted operation.

13. Limitation of liability

To the maximum extent permitted by law: (a) we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or trading or investment losses, arising out of or relating to the Service or these Terms, even if we were advised of the possibility; and (b) our total liability for all claims relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or USD 50. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or your statutory rights as a consumer.

To the extent permitted by law, you agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service or your violation of any law or third-party right.

15. Governing law and disputes

These Terms are governed by the laws of the country in which the operator of the Service is established, without regard to conflict-of-law rules. Before starting any claim, please contact us so we can try to resolve the issue informally within 30 days. To the extent permitted by law, claims must be brought individually and not as a plaintiff or class member in any class or representative proceeding. If you are a consumer, you keep any mandatory protections and any right to bring proceedings in the courts where you live that the law of your country gives you.

16. General

These Terms, together with the policies they link to, are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms; we may transfer ours in connection with a reorganisation or sale. We are not liable for delays or failures caused by events beyond our reasonable control.

17. Changes to these Terms

We may update these Terms. The date at the top shows the latest version. For material changes we will give notice on the Service or in our Discord server and may ask you to accept the new Terms when you next sign in. Continuing to use the Service after changes take effect means you accept them.
